These Terms govern your access to and use of websites and online services operated by the Martha’s Vineyard Safety Association (DBA “Tick Free MV”) and any subdomains, pages, or applications that link to these Terms (collectively, the “Website”). By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website. We may modify these Terms at any time; continued use constitutes acceptance of the updated Terms.

1) Authorized Use

You may use the Website only for lawful purposes and to learn about Tick Free MV’s mission, programs, publications, and opportunities to participate or donate (“Authorized Purposes”). For Authorized Purposes, you may (a) view pages in a browser, (b) print reasonable excerpts for personal or organizational use, and (c) share links to our pages, provided you do not remove notices or misrepresent the source. We may suspend or terminate access at any time.

2) Intellectual Property

All content on the Website—including text, graphics, logos, photographs, videos, and design—is owned by or licensed to the Martha’s Vineyard Safety Association and protected by copyright, trademark, and other laws. Except as expressly permitted in Section 1, you may not copy, modify, distribute, perform, display, create derivative works from, reverse engineer, or otherwise exploit any portion of the Website without prior written consent. Names, logos, and marks of Tick Free MV and the Martha’s Vineyard Safety Association may not be used without our permission. 

3) Acceptable Use

You agree not to: (a) violate any law or the rights of others; (b) upload or transmit malware or attempt to gain unauthorized access to our systems; (c) interfere with the Website’s operation; (d) use the Website to advertise or solicit without consent; or (e) misrepresent your identity or affiliation. We may take appropriate action for violations, including access restrictions.

4) Linking and Third-Party Sites

You may include a plain link to our home page or public pages, provided the link does not suggest our endorsement and does not alter the look or functionality of our Website. The Website may reference or link to third-party sites or services. We do not control or endorse third-party content and are not responsible for it; your use of third-party sites is at your own risk and subject to their terms and policies.

6) Health and Safety Information (No Medical Advice)

Content on the Website may discuss ticks, tick-borne diseases, prevention, and related topics. This information is provided for general educational purposes and is not medical advice. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition. Never disregard professional medical advice because of information on our Website.

7) Availability, Accuracy, and Changes

We try to keep the Website available and accurate but do not guarantee availability, completeness, timeliness, or accuracy. The Website and its content may be changed, suspended, or discontinued at any time without notice. We are not liable for any loss or harm arising from errors, omissions, interruptions, or discontinuations. 

8) Donations and Acknowledgments

If you choose to donate, you may be redirected to a third-party payment processor. Please review any third-party terms and privacy policies. Donations are generally non-refundable unless required by law. We may acknowledge donations publicly; donors who wish to remain anonymous should let us know at the time of the gift.

Tax-status notice: The Martha’s Vineyard Safety Association is a nonprofit corporation organized in Massachusetts and has applied to the Internal Revenue Service for recognition as a tax-exempt organization under Section 501(c)(3). Upon IRS approval, tax-exempt status will be effective as of September 2, 2025. Contributions made while our application is pending will be tax-deductible to the extent permitted by law once our exemption is granted. If, for any reason, our exemption is not granted, contributions may not be deductible.

THE WEBSITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. 

10) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE MARTHA’S VINEYARD SAFETY ASSOCIATION, TICK FREE MV, AND OUR OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY. TO THE EXTENT ANY LIABILITY IS FOUND, OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). 

11) Indemnification

You agree to indemnify and hold harmless the Martha’s Vineyard Safety Association (DBA Tick Free MV) and our officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the Website or violation of these Terms.

12) Governing Law; Venue

These Terms and any dispute related to the Website are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflicts-of-law rules. Exclusive venue lies in the state and federal courts located in Massachusetts (we suggest Dukes County or Suffolk County); you consent to personal jurisdiction in those courts and waive any objection to venue or forum non conveniens. 

13) Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver. You may not assign your rights or obligations under these Terms without our consent; we may assign them as permitted by law. Headings are for convenience only.
